The small-parts cylinder is arguably the single most-cited CPSC test in the toy-import industry. It is a physical cylinder, 1.25 inches in inside diameter, and any toy or removable part small enough to fit inside it is treated as a choking hazard. If the toy is intended for a child under 3 years old, the finding turns the product into a banned hazardous substance under 16 CFR 1501. If the toy is intended for a child age 3 through 6, the finding requires a specific choking-hazard warning statement under 16 CFR 1500.19. That single cylinder plus the age-grading pivot governs a large fraction of the CPSC compliance work every toy importer does. This guide walks the cylinder dimensions, the test method, the age-intent framework, the accepted testing labs, and where the finding lands in a CPSC Product Registry filing under the July 8, 2026 mandatory eFiling regime.
16 CFR Part 1501 was issued by CPSC under Section 8 of the Federal Hazardous Substances Act (FHSA), which authorizes CPSC to declare that a toy or article intended for use by children presents a choking, aspiration, or ingestion hazard under normal use or reasonably foreseeable damage or abuse. Products in scope that fail the small-parts test are banned hazardous substances; importing, offering for sale, or selling them in the U.S. is prohibited. The regulation is codified at 16 CFR Part 1501 in the eCFR.
The regulation was originally issued in 1979 in response to accumulated evidence of choking, aspiration, and ingestion deaths among children under 3 with toys and toy parts. The physical dimensions of the test cylinder derive from CPSC anatomical measurements of the fully expanded throat and pharynx of a child under 3, which set the physical upper bound on what a child under 3 can inhale, aspirate, or swallow whole.
16 CFR 1501.4 specifies the test cylinder physical dimensions:
Inside diameter: 1.25 inches (31.7 mm), circular cross-section.
Inside depth, shorter side: 1 inch (25.4 mm) minimum.
Inside depth, longer side: 2.25 inches (57.1 mm) maximum, with the interior floor sloping from the shorter side to the longer side.
Open top: Yes. The cylinder has an open top; the test object is placed inside without compression.
The test itself is straightforward: the test object (either the whole toy or a removable part) is placed inside the cylinder in any orientation. If the object fits entirely within the cylinder (below the plane of the open top) without compression, the object fails. If any portion of the object protrudes above the plane of the open top in every orientation, the object passes. The sloped floor means that a long, thin object might rest at an angle inside the cylinder; the test administrator checks all reasonable orientations before declaring a pass.
The regulation covers both the whole toy and any part that is or becomes removable in normal use or under reasonably foreseeable damage or abuse. A soft plush toy with sewn-on plastic eyes: if the eyes come off in the use-and-abuse tension test specified in ASTM F963, they are removable and must independently pass the cylinder test. A rattle with a small ball bearing inside a hollow chamber: if the chamber cracks in the drop test, the exposed ball bearing must pass the cylinder test. A doll with a detachable accessory (a hat, a shoe, a bag): the accessory itself is a separate test object.
The use-and-abuse test protocols in ASTM F963 (drop, tension, torque, compression, and flexure tests, applied per the toy category) are the operative simulations. A toy might pass the small-parts test in its as-received state and fail it after the specified tension test breaks off a small part; both states are tested and both matter for the compliance determination.
16 CFR Part 1501 applies to toys and articles intended for use by children under 3 years old. A toy in scope that contains a small part failing the cylinder test is banned outright. But CPSC also regulates toys and games intended for children age 3 through 6 that contain small parts: those are lawful but require a specific choking-hazard warning statement under 16 CFR 1500.19. The warning statement text and layout are specified in the regulation; a specific format (“WARNING: CHOKING HAZARD - Small parts. Not for children under 3 yrs.”) is required on the packaging.
The age determination is not just a manufacturer print on the box. 16 CFR 1500.87 establishes the framework: age grading printed on the packaging, marketing and advertising positioning, common recognition of the product as suitable for a specific age group, developmental appropriateness based on physical and cognitive considerations, and trade-association age recommendations. A manifestly infant-oriented product (soft plush, rattle-style acoustics, teething-shape geometry) does not shift out of the under-3 scope just because the manufacturer prints “3+” on the box. Conversely, a toy that is clearly age-appropriate for older children (small model kit, building set with instructions requiring reading) does not need to carry the warning if age-grading and marketing consistently point to age 8 and up.
16 CFR 1501.3 lists specific exclusions from the small-parts ban even where the product would otherwise be in scope: books and other paper products, writing materials such as crayons, chalk, pencils, and pens, molding materials such as clay, phonograph records, tapes, and CDs, and rattles subject to the separate 16 CFR 1510 rattle regulation. The exclusion list is narrow and specific; a product not explicitly excluded is in scope of the general test.
Rattles are the notable case: they are excluded from 16 CFR 1501 because they are governed by 16 CFR 1510 (rattle safety), which has its own specific test method for rattle geometry designed to prevent the rattle from entering an infant's mouth to a depth that would obstruct breathing. Rattles are intended by definition for children under 3 (that is the target-user population), so a separate physical-geometry regulation exists rather than the general small-parts test.
ASTM F963 is the American Society for Testing and Materials standard consumer safety specification for toy safety. CPSC adopted ASTM F963 as a mandatory children product safety rule under Section 106 of the CPSIA, which means compliance with ASTM F963 (in its current CPSC-referenced version) is legally required for children's toys sold in the U.S. ASTM F963 contains, among many other test methods, the small-parts test method that operationalizes 16 CFR 1501: it defines the test cylinder, the use-and-abuse simulation cycles, the tension and torque forces to apply, and the pass/fail determination procedure.
ASTM F963 is updated periodically. CPSC references the specific ASTM F963 version currently in force on the CPSC website; the reference version drives what version of the small-parts test the lab is expected to run. Merchants should verify with their lab which ASTM F963 version their test report cites, particularly when a test report is more than 12 months old, because CPSC will occasionally issue a Federal Register notice adopting an updated ASTM F963 version and shifting the compliance target.
A children's product subject to any children product safety rule (including the small-parts rule) requires a Children Product Certificate (CPC) under 15 USC 2063(a)(1). The CPC is a document that the importer or U.S. manufacturer generates identifying the product, the applicable children product safety rules the product complies with (referencing 16 CFR 1501 or 16 CFR 1500.19 as appropriate), the CPSC-accepted testing laboratory that conducted the underlying tests, the date and place of manufacture, and contact information for the person maintaining the underlying test records.
Under the 2026-07-08 CPSC Product Registry mandatory eFiling regime, the CPC lands in the eFiling packet at entry. CPSC and CBP have visibility into the CPC content at entry, and misalignment between the CPC (which rule set, which lab, which product configuration) and the physical shipment triggers a CBP hold or a CPSC request-for-information. Getting the CPC content correct upstream of the filing is now more operationally important than under the pre-eFiling paper regime.
CPSC maintains a list of CPSC-accepted third-party conformity assessment bodies at the CPSC laboratory search. Only a test report from a CPSC-accepted lab supports CPC issuance for a children product safety rule. The major toy-testing labs (Intertek, SGS, Bureau Veritas, TUV Rheinland, UL, and others) are accepted for the ASTM F963 scope; the list also includes smaller specialty labs accepted for narrower scopes.
A test report from an unaccepted lab does not support CPC issuance for the tested rule. Merchants who rely on a supplier-provided test report should verify that the issuing lab is on the CPSC-accepted list for the specific rule and scope tested; a report from an accepted lab for scope A does not support a CPC on scope B unless the lab is also accepted for scope B.
The recurring small-parts-related failure modes we see at CBP entry: (1) test report from an unaccepted lab (usually because the supplier used a lower-cost local lab that is not on the CPSC-accepted list); (2) test report covering a different product configuration than the shipment (color variant, size variant, packaging variant); (3) test report older than 12 months where CPSC has since referenced a new ASTM F963 version; (4) tracking label under 15 USC 2063(a)(5) missing or not matching the CPC content; (5) age grading on the packaging inconsistent with age grading in the marketing on the platform listing (a common Amazon or Shein failure where the platform listing shows the toy in play with a child clearly under 3 while the packaging carries a 3+ label); (6) warning statement layout under 16 CFR 1500.19 present but not in the specified format (font size, contrast, placement); (7) CPC references the wrong rule set (citing 16 CFR 1500.19 when the age grading actually triggers 16 CFR 1501).
Cross-border shipments from Chinese suppliers to U.S. e-commerce sellers are the highest-volume failure lane for the small-parts test. The specific pattern: a Chinese supplier sends a small-parts-containing toy that would pass 16 CFR 1501 with a 3+ age grade if the packaging and marketing were consistent, but the U.S. seller lists the same product on Amazon or on a marketplace with imagery showing children under 3 using the product. The imagery shifts the intended-user determination back into the under-3 scope, and CPSC treats the product as banned under 16 CFR 1501 regardless of the printed 3+ label.
Platform sellers on Shein, Temu, and TikTok Shop face additional scrutiny because CPSC and CBP have publicly signaled increased enforcement on marketplace shipments. Merchants who source small-parts-containing children's products from these platforms should independently verify the CPC, the third-party lab acceptance, the ASTM F963 version, and the intended-age framework before assuming platform-side compliance carries over to their own import-of-record obligations.

Products that fail the test on that age scope are banned outright as banned hazardous substances under Section 8 of the Federal Hazardous Substances Act. The test cylinder specified in 16 CFR 1501.4 is a cylinder with an inside diameter of 1.25 inches (31.7 mm), an inside depth of 1 inch (25.4 mm) at the shorter side, sloped up to 2.25 inches (57.1 mm) at the longer side, and an open top. A toy or removable part that fits entirely inside that cylinder (with no compression of the test object) fails the test. Toys and other articles intended for use by children under 3 years old that are made of any material, and that either are themselves small enough to fit in the test cylinder or contain a removable part that is. Excluded from the small-parts ban under 16 CFR 1501: books and other paper products, writing materials such as crayons and chalk, molding materials, phonograph records, tapes and CDs (in effect at the time of the regulation), and rattles subject to the separate 16 CFR 1510 rattle regulation. Toys for children age 3 through 6 are governed by the 16 CFR 1500.19 warning-label requirement rather than the small-parts ban.
They are two different regulatory outcomes on the same physical property. If a toy is intended for children under 3 and contains a small part that fits in the test cylinder, the product is banned under 16 CFR 1501. If the same toy is intended for children age 3 through 6 (as evidenced by age grading, packaging, marketing, and physical suitability), the product is lawful but must carry a small-parts choking-hazard warning statement under 16 CFR 1500.19. Age grading is the pivot: intended for under 3 triggers the ban; intended for 3-6 triggers the warning.
16 CFR 1500.87 establishes the framework for determining the age group for which a toy is intended. Factors include the age grading printed on the packaging by the manufacturer, the age labeling in marketing and advertising, the age group for which the product is commonly recognized as suitable, the age group for which the toy is developmentally appropriate based on physical, cognitive, and motor skill considerations, and any age recommendations from national trade associations or expert reports. A single low-print "3+" claim on the box does not automatically shift a manifestly infant-oriented product out of the under-3 scope; CPSC and CBP look at the totality of intent evidence.
ASTM F963 (the American Society for Testing and Materials standard consumer safety specification for toy safety, adopted by CPSC under Section 106 of the CPSIA) contains the small-parts test method that CPSC accepts. A test performed by an unaccepted lab does not support CPC issuance for the children product safety rule.
