Section 102 of the Consumer Product Safety Improvement Act of 2008 does one job: make sure a recall of a defective children's product can actually identify which units are affected. It does that by requiring every children's product to carry a "distinguishing permanent mark" — a tracking label — on the product itself and on its packaging. The requirement is codified at 15 USC 2063(a)(5), it took effect for children's products manufactured after August 14, 2009, and it has been in continuous force ever since. This guide walks the requirement end to end for a 2026 importer or U.S. manufacturer: what has to be on the label, where it goes, how "to the extent practicable" actually flexes for tiny products, how the tracking label sits alongside the separate choking-hazard warning under 16 CFR 1500.19, how it lands in the CPSC Product Registry filing under the July 8, 2026 mandatory eFiling regime, and what happens when a container arrives at port and the tracking labels in the filing packet do not match the tracking labels on the units.
Section 102 of the CPSIA amended Section 14 of the Consumer Product Safety Act. The operative language, from the U.S. Code, requires the manufacturer of a children's product to "place permanent, distinguishing marks on the product and its packaging, to the extent practicable, that will enable" the manufacturer and the ultimate purchaser to ascertain the manufacturer or private labeler, the location and date of production, cohort information including batch or run number, and any other information the manufacturer determines useful to identify the source. The full text is at 16 CFR Part 1130 and the underlying statute at 15 USC 2063.
The definition of "children's product" that triggers Section 102 is the same one used for third-party testing and the Children's Product Certificate: a consumer product designed or intended primarily for children 12 years of age or younger, per 15 USC 2052(a)(2). CPSC applies a four-factor test drawn from the statute to determine whether a product qualifies — manufacturer's stated intent, product packaging and marketing, category convention, and the Age Determination Guidelines CPSC publishes on its own site. When a product is clearly for adults (a kitchen knife, a power drill) Section 102 does not apply. When a product is clearly for children (a plush toy, a onesie, a bike helmet in a child size) it does. The gray-zone products — a bath towel with cartoon characters, a lamp shaped like a cartoon character — are the ones that need the four-factor analysis on file.
The statute lists four categories of information that have to appear on a tracking label. In current CPSC practice they resolve to:
1. Manufacturer or private labeler name. The legal entity responsible for the product under U.S. law. For a domestic manufacturer this is the U.S. entity that made it. For an imported product this is the private labeler or the importer of record, at the importer's election, provided the name resolves to a real, contactable business. A trade name is fine if it is registered and traceable; a fictitious or unregistered brand-only name is not.
2. Location of production. At minimum, city and country. For imported goods this is the actual production location, not the U.S. warehouse the container ended up at. A product molded in Guangdong is marked Guangdong, even if it is packaged in Ohio.
3. Date of production. Month and year at minimum. The date has to correspond to when the product was actually produced, not when it was shipped or when it entered U.S. commerce. A common shortcut is a Julian date code plus a two-digit year (e.g. 235-26 for the 235th day of 2026), which is compact enough for most product surfaces and unambiguous to decode. Cryptic vendor-internal codes that cannot be interpreted without an internal key are technically permitted, but they trip up recall correspondence and CPSC investigators, and CPSC has publicly discouraged them for this reason.
4. Cohort information: batch, run, or lot number. This is the identifier that lets a recall isolate exactly which units are affected. If a defective batch of a car-seat clip ships in production run R2126, a recall can pull "all R2126 units," not "all units produced in 2026." The cohort identifier resolves the granularity gap between the month-and-year production date and the individual serial number that consumer products typically do not carry.
The statute also includes the "any other information to facilitate ascertaining the specific source of the product" catch-all, which manufacturers often use to encode a supplier code, a mold cavity number, or a facility identifier. None of these are individually required; they earn their space when the manufacturer's own recall workflow benefits from the granularity.
The statute uses the phrase "to the extent practicable," and CPSC has consistently applied it as a flexibility clause, not an escape hatch. The intended meaning: if the product's physical form makes full four-element on-product marking impossible — a hard candy under a wrapper, a marble, a foam die-cut — the manufacturer marks the product with an abbreviated identifier that still traces uniquely to the batch, and the full four-element label lives on the packaging. What "to the extent practicable" does not permit is dropping the label from the packaging as well, or replacing the batch code with a generic manufacturer stamp, or shifting the entire label to a hangtag that is discarded at first use. The CPSC Office of Compliance has issued civil-penalty announcements for tracking-label failures in exactly this shape, and the CPSC recall database on cpsc.gov/Recalls regularly cites tracking-label deficiencies in the recall notice itself when the deficiency contributed to the harm.
Practical rule of thumb, drawn from CPSC's own Small Business Ombudsman guidance: if the product has a flat surface at least 1" by 0.25" that can carry an ink stamp, engraved mark, or heat-transferred label without interfering with function or safety, the on-product mark is expected. Below that size, the abbreviated on-product mark plus full packaging label is the pattern. Zero on-product marking is only defensible when the product is small enough that any marking would be a choking-hazard or a safety issue itself, and even then the burden of proof sits with the manufacturer.
The Section 102 tracking label is one of several separate labeling regimes that can apply to the same children's product at the same time. The one most often confused with it is the small-parts choking-hazard warning under Section 24 of the Federal Hazardous Substances Act, codified at 16 CFR 1500.19. That regulation requires an explicit "WARNING: CHOKING HAZARD — Small parts" statement on any toy or game intended for children ages 3 through 5 if the product or any of its parts, pieces, or components fits entirely within the small-parts cylinder specified at 16 CFR Part 1501. The cylinder has an internal diameter of 1.25" and a sloped bottom — any component that fits entirely inside it in any orientation triggers the warning.
Two labeling systems, two separate purposes: the tracking label answers "which unit is this," the choking-hazard warning answers "is this safe for a 3-year-old to play with." Both are printed on the same package for a small-parts toy in the 3-to-5 age band. Both have to be present for the product to lawfully enter U.S. commerce. Neither substitutes for the other. Products under 3 years old face a categorical prohibition on containing small parts under 16 CFR 1501.4 rather than a warning — the warning is for the 3-to-5 range where the small part is permitted with disclosure.
Additional labeling regimes that stack on top of Section 102 for various children's product categories include: the Poison Prevention Packaging Act child-resistant packaging labels ( 16 CFR Part 1700), the flammability labeling for children's sleepwear ( 16 CFR Part 1615), and cadmium/lead/phthalate content restrictions under 15 USC 1278a that require separate testing and certification but not a specific on-product label beyond the tracking label itself. The Section 102 tracking label is category-agnostic: it applies to every children's product regardless of what other rules also apply.
The Section 102 tracking label lives on the physical unit. The Children's Product Certificate lives on paper (or, since the July 8, 2026 mandatory eFiling regime, in the CPSC Product Registry). Both are required for the same children's product under 15 USC 2063(a), and they answer different questions: the CPC answers "does this SKU pass every applicable children's product safety rule, and which lab tested it," while the tracking label answers "which specific batch of this SKU is this unit from."
Since the CPSC eFiling mandate took effect on 2026-07-08, the CPC data flows into the CPSC Product Registry as structured data at the time of entry, replacing the paper-CPC-with-broker regime. The Product Registry filing packet includes the tracking-label information for the units in the container, so a CBP officer or a CPSC investigator can cross-reference "the units in this container carry batch code R2126" against the manufacturer's CPC and the third-party test report. When the batch code on the units does not match what the filing packet says is inside, CBP holds the container pending resolution. This is the point in the workflow where a small importer with sloppy tracking-label data collection loses days of dwell time to a preventable mismatch.

CPSC enforcement of Section 102 shows up in three places. First, when a recall happens, missing or defective tracking labels can amplify the recall's cost by expanding the affected-unit universe far beyond the actual defective batch — a recall that could have identified 4,000 defective units by batch code instead has to sweep 40,000 units of the same SKU. Second, the CPSC Office of Compliance issues warning letters when tracking-label deficiencies surface during routine port surveillance or in-market inspection; the warning-letter regime is documented in the general CPSC warning-letter response guide. CPSC has never issued a rigid list of approved marking methods for Section 102, because the practicable answer depends on the substrate. The categories that pass in current CPSC practice include: molded-in text (raised or recessed) on hard plastic products; laser-etched marks on metal and hard-plastic products; heat-transferred labels bonded to fabric or laminated onto plastic; permanent-ink stamps on wood, cardstock, or hard plastic (verified to survive expected washing and abrasion); and RFID or QR-code tags physically integrated into the product where the underlying digital record includes the four Section 102 elements. Categories that generally fail in current practice: paper hangtags removable by design; pressure-sensitive adhesive labels not rated for the product's expected lifetime; ink-jet codes on fabric that wash out; and any "label" that is a shipping-carton marking discarded before retail.
The functional test: after the product has been through its expected use (a plush toy through a washing machine, a bike helmet through a season of outdoor use, a bath toy through 200 baths) can the four Section 102 elements still be read? If yes, the mark passes. If no, the mark is not "permanent" within the meaning of Section 102 and needs to be redesigned before the next production run.

This is a hypothetical scenario, not a real case. Consider a small importer of children's wooden blocks bringing in a 20-foot container from a factory in Vietnam. The factory heat-stamps the manufacturer name and country on the underside of each block and heat-stamps a batch code on the packaging box, which meets the "to the extent practicable" standard for a product where individual on-block marking of the full four elements would obscure the play surface. The importer's Children's Product Certificate cites a valid third-party CPSIA lab and a batch code of L2604-VN. The physical batch code stamped on the boxes reads L2604VN (no hyphen). At CBP, an officer running a Product Registry cross-check flags the mismatch. The container is held pending resolution. The importer has to re-file with the corrected batch code, and the correction is a paperwork exercise that takes hours — but the hold takes days. Ink stamps that survive washing on a fabric product, engraved or molded marks on a hard-plastic product, and heat-transferred labels on a metal product all pass. A paper hangtag that falls off before first use does not.
The statute requires the tracking label on both the product and its packaging. When product surface area or design makes on-product marking impracticable, CPSC guidance permits abbreviated on-product marking (a short manufacturer code plus batch identifier) paired with a full four-element label on the packaging. Some categories (children jewelry, small toy figurines) rely heavily on the packaging label under the to the extent practicable clause.
